Facts
In 1974, a 345-acre wildfire occurred in Camden Hollow, an area within Illinois’s Pere Marquette State Park. In 1978, the Illinois Department of Conservation (department) (defendant) proposed a commercial timber harvest and sale in the burn area. The sale was intended to include 438 dead trees and 1,638 live trees. The department argued that it was necessary to salvage the dead trees before the timber rotted and that removal of the dead and damaged trees would protect the forest from disease or insect infestation. The Sierra Club (plaintiff) sought an injunction in state circuit court to prevent the sale from moving forward. The circuit court denied the injunction, but the Illinois Court of Appeals reversed. The department then appealed to the Illinois Supreme Court.
