Facts
After a jury awarded Silver Sage Partners, Ltd. (Silver Sage) (plaintiff) [$3,040,439] in Silver Sage’s trial against the City of Desert Hot Springs and others (defendants), the federal district court ordered a new trial on the issue of damages because of issues including causality, insufficiency of the evidence, and failure to mitigate. Silver Sage petitioned the United States Court of Appeals for the Ninth Circuit for a writ of mandamus directed to the district court.
