Facts
H. Jack Mizell (defendant) owned Shelley Broadcasting, Inc., and Stage Door Development, Inc., which in turn operated two radio stations. Both stations broadcast religious services during which a total of 15 copyrighted songs were performed without permission. The copyright holders, which included various members of the American Society of Composers, Authors and Publishers (ASCAP members) (plaintiffs), brought suit in federal district court.
