Facts
Simpson Lumber Company (Simpson) (plaintiff) filed a complaint to quiet title and for declaratory relief against the State of California (defendant) and sought title to specific parcels of land in and near a state park. The land claimed by Simpson was donated to the state from a conservation organization group, Save-The-Redwoods League (the League), by grant deeds that required the land be used for state park purposes. The League moved to permissively intervene in the action under California Code Civ. Pro. § 387(a). The trial court denied the League’s motion to intervene, and the League appealed.
