Facts
California Pizza Kitchen, Inc. (CPK) (defendant) used partially hydrogenated vegetable oil (PHVO) in its frozen pizzas. Simpson (plaintiff) filed a class action suit against CPK, claiming that the use of PHVO constituted a public nuisance. Simpson claimed that PHVO was dangerous to consume because it could cause health problems. Simpson stated that in addition to the physical harm she incurred by consuming the frozen pizzas, she also suffered emotional harm after feeding the pizzas to her children. CPK filed a motion to dismiss.
