Facts
Peter Skafte was a permanent resident alien in Boulder, Colorado. Skafte was denied the right to register to vote in school elections because he was not a United States citizen. Skafte brought suit in district court and challenged the constitutionality of the Colorado statute that permitted only United States citizens to vote, arguing that the statute violated the Equal Protection Clause. The district court ruled that the statute was valid. Skafte appealed.
