Facts
Slavin (plaintiff) was a landlord who sought to evict a tenant because the tenant assigned his lease to someone without Slavin’s consent in violation of their lease agreement. The Rent Control Board of Brookline (Board) (defendant) refused to allow Slavin to evict the tenant because it read an implicit agreement into the lease that the landlord would not unreasonably withhold consent. Slavin brought this action for declaratory enforcement of the lease agreement.
