Facts
Smart Technologies ULC (Smart) (plaintiff) was in a contractual relationship with Rapt Touch Ireland Ltd (defendant), and a dispute arose between the parties. The contract contained an arbitration clause that the parties agreed was enforceable. Under this provision, a party could seek emergency relief from court under certain limited circumstances. Smart sought a temporary restraining order (TRO) pursuant to this provision. However, Smart admitted at a hearing on the TRO that the arbitration rules allowed Smart to request emergency relief from an arbitrator, which would be acted on much faster than in court. Smart nonetheless sought emergency relief in federal court because the relief would be granted automatically.
