Facts
Calvin Smith (defendant) was indicted for conspiracy to distribute narcotics and conspiracy to violate the Racketeer Influenced and Corrupt Organizations Act. Before trial, Smith moved to dismiss the conspiracy counts on the ground that he had withdrawn from the charged conspiracies outside the applicable five-year statute of limitations. The district court denied the motion. At trial, Smith renewed his defense. A jury of the District Court for the District of Columbia convicted Smith on the conspiracy counts. The court of appeals affirmed. Certiorari was granted.
