Facts
Michael Smyth (plaintiff) was an employee of Pillsbury Co. (Pillsbury) (defendant). Pillsbury maintained an internal email system to promote communication between its employees. Pillsbury repeatedly assured its employees that all email communications would remain confidential and privileged. Smyth was later fired by Pillsbury. Pillsbury cited inappropriate emails sent by Smyth to his supervisor through Pillsbury’s system. Smyth sued Pillsbury, citing his right to privacy.
