Facts
Alvin Snyder and others were partners in Twin Lakes Partnership (collectively, Twin Lakes) (defendants). Twin Lakes planned to build apartments and hired Herbert Greenbaum and Associates, Inc. (Greenbaum) (plaintiff) to provide and install carpet in the apartments for $87,600. Greenbaum purchased the carpet, but before Greenbaum could install it, Twin Lakes canceled the contract. Greenbaum resold the carpet and sued Twin Lakes for breach of contract. The trial court made no finding on whether Greenbaum was a lost-volume seller, and no party proved the amount of Greenbaum’s resale proceeds. The trial court awarded Greenbaum $19,407.20. Twin Lakes appealed, arguing Greenbaum was not entitled to lost profits, but even if Greenbaum was entitled to lost profits, Greenbaum did not prove its resale proceeds and therefore could collect only nominal damages.
