Facts
Société Nationale d’Opéraciones Pétrolières de la Côte d’Ivoire-Holding (Petroci) (plaintiff) and Keen Lloyd Resources Ltd. (Keen) (defendant) arbitrated a dispute in France under the rules of the International Chamber of Commerce. The arbitration agreement stated that any arbitration agreement between the parties would be binding. Petroci obtained an award against Keen and was granted leave to enforce the award in Hong Kong. Before Petroci commenced the enforcement proceedings in Hong Kong, Keen appealed the arbitral award in French court. Keen sought to set aside the leave to enforce the award in the Hong Kong High Court, arguing that the award was not final and binding because of the pending appeal in France.
