Facts
Sofillas (plaintiff) was injured while using a hot tub on board a cruise ship owned by Carnival Corporation (defendant). Sofillas sued Carnival and planned to call Alison Osinski as an expert witness. Osinski was an expert in the maintenance and operation of hot tubs. Osinski planned to opine that Carnival was negligent in the way it operated and maintained the hot tub and in the way that it warned passengers about uses and potential dangers. Carnival objected to the testimony on the ground that it improperly opined on the ultimate issue in the case, Carnival’s negligence.
