Facts
The Developmental Driller I (DDI) was a $350,000,000 semi-submersible drilling platform owned by GlobalSantaFe Drilling Co. (GSF) (defendant) and located in the Gulf of Mexico. Louis Solana and Brendan Lally (plaintiffs) were GSF employees stationed on the DDI. As Hurricane Katrina approached the region, GSF evacuated all personnel off the DDI, which was seriously damaged in the storm. After Katrina had passed, Solana and Lally agreed at GSF’s request to be part of a crew that returned to the drifting and severely listing DDI in an effort to stabilize and save the platform. After returning to the DDI, this crew restored power and counteracted flooding sufficiently for a salvage firm to be able to tow the DDI into port, where it was eventually repaired. Solana and Lally sued GSF for a salvage claim for their efforts. The district court entered summary judgment for GSF, and Solana and Lally appealed.
