Facts
In 1974, the German Constitutional Court held that because the level of protection afforded to civil rights under community legislation was insufficient to ensure that civil rights would be secured for German citizens, German courts were required to request a decision from the German Constitutional Court if the court believed that an application of community legislation conflicted with the guarantees of civil rights provided for under the German Constitution.
