Facts
John Soldano (plaintiff) was driving through Yosemite National Park with his wife. Soldano was driving down a road that had a 35 miles-per-hour speed limit. The road curved around a mountain just before it intersected with a bridge. As Soldano drove along the curve at the speed limit, he saw a van stopped in his lane as he approached the intersection. The van suddenly appeared just after the road curved around the mountain. Soldano had to abruptly slam on the brakes and swerve into the other lane in order to avoid the van, but he collided with a different van in the other lane. Soldano brought suit against the United States (defendant), claiming the National Park failed to place a sign warning of the blind curve and to set a safe speed limit. The trial court granted summary judgment in favor of the United States. Soldano appealed.
