Facts
August Solet (plaintiff) was working on the motor vessel Capt. H. V. Dufrene (defendant), a trawler, when a winch cable failed, causing Solet to be injured. The trawler was owned by Elvin Dufrene, but Dufrene did not employ Solet himself. Solet filed suit, seeking damages in district court. Among the remedies Solet sought was the ancient remedy of maintenance and cure. Solet sought maintenance and cure against both Dufrene and the trawler.
