Facts
The Department of Labor (DOL) (plaintiff) filed a complaint alleging SCA Restaurant Corp. and its owner, Luigi Quarta (defendants) failed to pay minimum wage and overtime compensation and to keep accurate wage and hour records under the Fair Labor Standards Act (FLSA). The DOL sought to enjoin future violations and recover as damages overtime compensation the restaurant owed employees. Quarta filed for bankruptcy and argued the automatic bankruptcy stay applied to stay the DOL action.
