Facts
Mrs. Somps (plaintiff) and Mr. Somps (defendant) were married when Mr. Somps purchased investment property with his business partner, using his separate funds rather than community funds. During the divorce proceeding, Mrs. Somps claimed that Mr. Somps breached his fiduciary duty to use available community-property funds to purchase the investment property. The trial court found that Mr. Somps had not breached any fiduciary duty.
