Facts
Sophia Loren (plaintiff) was a highly regarded actress in the film industry. Loren entered into an agreement with Samuel Bronston Productions (defendant) to star as the female lead in the film El Cid. The agreement stated that Loren would receive second-star billing, behind that of the male lead. Further, Loren was to receive her second-star billing above the title of the film; in the same size and font as the title; and on the same size, line, and prominence as that of her male costar. The film opened at the Warner Theatre in New York City. The electric sign on the theater displayed Loren’s name below her male costar’s and in a smaller font than the title El Cid. Loren filed suit for noncompliance with the billing-credit terms within the agreement. Loren moved for a preliminary injunction to enforce the terms during the pendency of the suit.
