Facts
Southern Farm Bureau Life Ins. Co. (Farm Bureau) (plaintiff) issued a life insurance policy, covering the life of Mr. Davis, with a face value of $95,000. The policy named his wife Robyn Davis (defendant) as the beneficiary. Mr. Davis died, and Ms. Davis was arrested and charged with killing him. Under Louisiana law, if Ms. Davis is found to be criminally responsible for Mr. Davis’s death or to have participated an intentional, unjustified killing of Mr. Davis, then Ms. Davis cannot recover the proceeds of Mr. Davis’s life insurance policy. If the primary beneficiary is disqualified, and there is no contingent beneficiary, the life insurance proceeds are to be paid to the estate of the insured. Farm Bureau filed an interpleader action, listing Ms. Davis and Mr. Davis’s estate as defendants, to determine who should receive the proceeds of the life insurance policy. Ms. Davis moved to dismiss the lawsuit based on a lack of subject matter jurisdiction.
