Facts
The South Dakota legislature enacted S.D. Codified Laws § 34-11B (the statute), which authorized municipalities to establish a regional emergency-medical-services authority (EMS authority). The statute defined an EMS authority as an independent public body. Pursuant to the statute, the city of Sioux Falls (defendant) created the Sioux Falls Regional Emergency Medical Services Authority (SFREMSA). Michael Specht (plaintiff) brought suit, contending that the statute was unconstitutional. The trial court agreed with Specht and found that the statute was unconstitutional. The city of Sioux Falls appealed.
