Facts
Justin Laliberte (defendant) worked for V.I.P., Inc. (VIP) (defendant) as a warehouse employee. VIP sponsored a local car show and paid Laliberte and other workers who volunteered to help with the show’s setup. On his way home from the setup, Laliberte collided with a vehicle containing James Spencer (plaintiff) and Spencer’s wife and daughter. The collision killed the wife and injured Spencer and his daughter. Spencer sued Laliberte and VIP for damages. The trial court granted VIP’s motion for summary judgment on the grounds that Laliberte was not acting within the scope of his employment at the time of the collision. Spencer appealed to the Maine Supreme Judicial Court.
