Facts
The Coleman Company, Inc. (Coleman) (defendant) was a sporting-goods store whose products included personal flotation devices. Coleman held a design patent on an ornamental design for a flotation device consisting of two armbands connected to a torso piece. Sport Dimension, Inc. (plaintiff) sold a personal floatation device whose design was similar except that its torso section took the shape of a vest that went over the user’s shoulders. Sport Dimension sought a declaratory judgment that its flotation device did not infringe Coleman’s design patent. The federal district court held that several features of Coleman’s claimed design, including the left and right armbands, were functional rather than ornamental. Coleman moved for judgment in favor of Sport Dimension so that it could appeal the claim construction to the United States Court of Appeals for the Federal Circuit.
