Facts
St. Francis College (college) (defendant) denied tenure to Al-Khazraji (plaintiff), an Arab associate professor. Khazraji sued the college pursuant to 42 U.S.C. § 1981, alleging that it had discriminated against him because of his race. The college argued that § 1981 protects against racial discrimination but not against ethnic discrimination. In support of this argument, the college claimed that Arabs are racially classified as Caucasian, and it is impossible for a Caucasian to state a claim for racial discrimination against other Caucasians. The district court ruled that § 1981 does not protect against discrimination based on ancestry. The court of appeals reversed, and the United States Supreme Court granted certiorari.
