Facts
The St. Helen Development Company (the development company) owned all of the land surrounding Lake St. Helen. The development company conveyed the exclusive right to hunt on all of that land, along with ownership of 12 acres of the land, to the St. Helen Shooting Club (the club) (plaintiff). The development company later conveyed another parcel of the land bordering the lake to Mogle (defendant), subject to the exclusive hunting right held by the club. Mogle began running a summer resort on the land he acquired and began infringing on the club’s exclusive right to hunt on the land. The club sued Mogle to enjoin him from infringing on this exclusive right. The lower court dismissed the club’s exclusive right to hunt on the land as against public policy. The club appealed.
