Facts
Barbara Jean Price (plaintiff) suffered an injury while employed part-time as a cleaner for five different employers, including St. Mary’s Church & Mission (St. Mary’s) (defendant). Price worked at St. Mary’s once per week at the rate of $40. Price earned $377 weekly from her remaining four jobs. At the time of injury, Price was specifically working at St. Mary’s, and as a result of her injury, Price was unable to perform duties for all of her employers. Price filed for workers’-compensation benefits. St. Mary’s admitted to liability of $40 weekly. Price contested and claimed entitlement to benefits based on her gross weekly income of $417 from all five employers. The hearing officer ruled in favor of Price. The decision was affirmed by the Colorado Industrial Commission (the commission). St. Mary’s and its carrier, the Archdiocese of Denver, c/o Gallagher Bassett Insurance Company (Gallagher) (defendant), filed a petition for review of the commission’s decision.
