Facts
On March 9, 1977, F & S Petroleum Company, Inc. (F & S) (plaintiff) and John B. Stacks (defendant) entered into an agreement whereby F & S would supply up to 50,000 gallons of gasoline per month to Stacks’ gas station. Stacks refused to pay, and F & S sued Stacks to recover the outstanding balance. Stacks argued the agreement was too indefinite to enforce because it did not specify a minimum amount of gasoline Stacks was required to purchase in a month. The jury found in favor of F & S. Stacks appealed.
