Facts
In a Pennsylvania case tried in state court, the defense called Jonas Phillips as a witness. The trial was being held on a Saturday. Phillips held Jewish religious beliefs and, for religious reasons, refused to testify on what he considered the Sabbath. The court fined Phillips for refusing to testify. The defendant then waived the right to have Phillips testify, and the court excused Phillips from having to pay the fine.
