Stanton v. United States
United States District Court for the Eastern District of New York
186 F. Supp. 393 (1960)

- Written by Jessica Rice, JD
Facts
At the end of his employment, Alden Stanton (plaintiff), who had received his full salary, received an additional financial gift from the Vestrymen of Trinity Church (the Vestrymen). The characterization of the additional funds was challenged in district court. The Vestrymen testified that due to Stanton’s genuine stewardship during a difficult period, they wanted to gift him more than just a written resolution. The United States (defendant) argued that the additional payment to Stanton must have been either a personal gift by the Vestrymen with the intention of subverting corporate property or an award of severance pay for Stanton. The district court found for Stanton. Several appeals followed, and the case returned to the district court.
