Facts
Plaintiff was employed by the defendant to perform services on the defendant’s farm. The contract was for a term of one year and the defendant agreed to pay the plaintiff $120. The defendant occasionally made partial payments to the plaintiff over the first few months of the year. However, before the end of the year, the plaintiff stopped working for the defendant, thus breaching the contract. The plaintiff then brought suit against the defendant to recover a prorated amount of money for the services he had performed up to the point of his breach. The court of common pleas found in favor of the plaintiff. The defendant appealed.
