Facts
In 1985, a union was certified as the exclusive representative for a bargaining unit comprising employees working for Miami University (Miami) (defendant). When the collective-bargaining agreement between Miami and the union expired in 1989, an employee in the unit petitioned Ohio’s State Employment Relations Board (SERB) (plaintiff) for a decertification election, meaning a vote showing a majority of Miami’s employees no longer wanted union representation. SERB dismissed the petition without ordering a decertification election. Miami appealed.
