State ex rel. M.B.
Utah Court of Appeals
198 P.3d 1007 (2008)
- Written by Rich Walter, JD
Facts
M.B. (defendant), a minor, sat in the front passenger seat of an idling car. Meanwhile the car's adult driver, to whom M.B. was related, and the driver's companion stole goods from a truck parked across the street. Police arrested all three individuals. Like the others, M.B. was dressed in dark clothes. The car's glove compartment contained screwdrivers and a pair of gloves, and another screwdriver was wedged between the console and M.B.'s seat. These items might have been used in the crime. The car's trunk contained a car stereo with some of the truck's wiring still attached. The State of Utah (plaintiff) charged M.B. with vehicular burglary, theft, unlawful possession of burglary tools, and receiving stolen property. The juvenile court found M.B. guilty and he appealed to the Utah Court of Appeals.
