Facts

Polytech, Inc. (plaintiff) sued its broker, Sedgwick James of Missouri, Inc. (Sedgwick James) (defendant) for not obtaining sufficient insurance. During a deposition, Douglas Hazel, a Polytech officer, admitted to writing a one-page document summarizing his involvement with Sedgwick James. Hazel gave the document to Polytech’s attorney and reviewed it before his deposition. Sedgwick James requested the document, contending that it was subject to disclosure because Hazel had used it to prepare for his deposition. The trial court ordered Polytech to produce the document. Sedgwick James appealed. The appellate court affirmed the trial court’s decision, and the Missouri Supreme Court granted review.
