Facts
Martin Quihuis (defendant) was charged with molestation of a child and dangerous crimes against children. The victims were two cousins who lived with Quihuis and the children’s legal guardians. The state (plaintiff) moved for the appointment of representatives other than the children’s legal guardians to represent the interests of the children as victims of the charged offenses. The trial court denied the state's motion. The state filed a special action in the Arizona Court of Appeals. Quihuis argued that appointment of representatives for the children would violate the presumption of innocence to which he was entitled.
