State in the Interest of D.J.
Louisiana Supreme Court
817 So. 2d 26 (2002)
- Written by Mary Katherine Cunningham, JD
Facts
The state (plaintiff) charged D.J. (defendant) and another juvenile defendant with attempted second-degree murder and carrying a firearm on school property in a juvenile-delinquency petition. D.J. filed a motion for a jury trial in juvenile court, and the juvenile court granted the motion. The juvenile court found that the Louisiana statute forbidding jury trials for serious delinquency proceedings was unconstitutional. The state appealed to the Louisiana Supreme Court.
