Facts
Gambling, in nearly every form except traditional bingo, was illegal under Alabama state law. The State of Alabama (plaintiff) discovered that several companies, including Epic Tech, LLC, (collectively, the companies) (defendants) were operating illicit gambling devices in Alabama. The machines resembled and functioned like traditional slot machines rather than legal bingo games. The machines were fast-paced, required no skill, and did not involve the simultaneous, manual, and interactive play associated with traditional bingo. After local law enforcement failed to shut down the illegal gambling operations, the state brought an action for declaratory and injunctive relief against the companies. The trial court denied the state’s request for injunctive relief, finding that the state had failed to demonstrate that the companies’ activities constituted a public nuisance. The state appealed.
