Facts
The State University of New York at Buffalo (plaintiff) received a preliminary injunction barring the actions of students who had protested on campus. The injunction stated it applied to several named students and to “all persons receiving notice of this preliminary injunction.” The injunction was posted around campus. Later, 45 faculty members (defendants) protested by entering the university president’s office and refusing to leave. The university applied for a criminal contempt-of-court order against the faculty. The court granted the university’s application, and the faculty appealed to the New York Supreme Court, Appellate Division.
