Facts
Michael Arnold was seen by a store manager removing four packs of bacon from the store’s meat cooler and putting them in his coat. Arnold noticed that the store manager was watching him and put the bacon back in the cooler and left. Arnold was indicted for attempted theft. Arnold’s defense at trial was that he was not guilty of attempted theft because he had abandoned or renounced his criminal intent before his arrest.
