Facts
Ricky Baugh (defendant) and juveniles Greg Cain, Gary Worley, and Jeff Niehaus (the juveniles) planned to rob a café. Baugh and the juveniles drove to the café. After peering in the window, Baugh, Cain, and Worley entered the café, leaving Niehaus in the car. Baugh had a gun in the car that he may have carried into the café. One juvenile had a gun, and one had a pillowcase. Upon entering, Baugh, Worley, and Cain, wearing or carrying knit caps, proceeded to the restroom. Cain and Worley left the restroom and sat in the café’s tavern. Baugh went to the delicatessen area. After a few minutes, Cain and Worley left. Baugh stayed about 10 minutes and left. A police officer responding to a call searched Baugh and did not find a weapon. As Baugh and the juveniles drove away, the car was stopped. A search uncovered two pistols and a pillowcase. Baugh was convicted of conspiracy to commit aggravated robbery and appealed.
