State v. Billings
Washington Court of Appeals
4 Wash. App. 2d 1014 (2018)
- Written by Alexander Hager-DeMyer, JD
Facts
Scott Soden and Angela Frank drove to a mobile-home park to purchase marijuana. Soden and Frank were waiting in their vehicle when Christopher Billings (defendant) pulled up next to them. Billings believed that Soden and Frank had information about some missing marijuana and approached their vehicle with a machete. After a brief verbal altercation, Billings slashed at Soden in the driver’s seat, cutting Soden’s wrist to the bone. If Soden’s wrist had not been hit, the machete would have struck Frank in the leg. Frank was fearful for her life and called the police. Billings was convicted in Washington superior court of two counts of second-degree assault with a deadly weapon, one for Soden and one for Frank. Billings appealed the convictions to the Washington Court of Appeals. Among other claims, the appellate court addressed whether there was sufficient evidence to find that Billings assaulted Frank.
