Facts
Jesse Black (defendant) and his wife, Tamsey, were living apart from each other. Black was passing the house in which Tamsey resided when Tamsey called to him angrily and asked if he had patched a certain woman’s bonnet. Black followed Tamsey into the house. Tamsey again asked about the bonnet, and the couple quarreled. Black grabbed Tamsey’s hair, pulled her to the floor, and held her there. Tamsey continued to verbally abuse Black when she got up. Black was indicted for assaulting Tamsey. Tamsey testified that Black did not strike or choke her but that her head was hurt, her throat was injured, and her throat remained sore for several months. Black was found guilty, subject to the court’s opinion. The court agreed with the state (plaintiff). Black appealed.
