Facts
Gary Bonner (defendant) was arrested for secretly videotaping a teenage girl in various stages of undress from outside of her window through gaps in the window blinds. He was convicted of sexual battery of a minor child under an Idaho statue that made it a felony to make a photographic or electronic recording of a minor with the intent of arousing or gratifying lust. Bonner appealed his conviction, alleging that the statute violated the Constitution because it was overbroad on its face and void for vagueness.
