Facts
Courtney Brown (defendant) was pulled over by a police officer, Christopher Deering, for failing to make a complete stop at a stop sign. Deering wrote a ticket for the traffic violation and, while doing so, also conducted a search of Brown’s record. The search uncovered prior arrests for drug crimes and armed robbery. Deering then asked Brown to step out of the car. Deering requested consent to search Brown, which was given. Deering found cocaine. The state (plaintiff) charged Brown with possession with intent to deliver as a repeat offender. Brown moved to suppress the cocaine, arguing that Deering conducted the search without reasonable suspicion, making the extension of the initial traffic stop unlawful. The trial court denied the motion and sentenced Brown to two years in prison and two years of extended supervision. Brown appealed. The appellate court affirmed. Brown again appealed. The Wisconsin Supreme Court granted certiorari.
