Facts
Jorge Carlos Centeno-Sarabia (defendant) was charged with sexual abuse and sexual conduct with a minor. At trial, the prosecution called Officer Gary Hodgekiss to testify. Hodgekiss had responded to the 911 call resulting from the crime but also had known the victim for approximately three years. Hodgekiss testified over Centeno-Sarabia’s objection about the victim’s developmental delays and stated that she had no imagination and was “absolutely not capable of fabricating a story.” Centeno-Sarabia was convicted, and he appealed.
