Facts
Officer Day pulled over a vehicle driven by Cora (defendant) after Cora ran a red light and cut off Day’s police car. During the stop, Day smelled marijuana, and Cora admitted to having previously smoked marijuana inside the vehicle. When an officer assisting Day asked a passenger to get out of the vehicle, the officer noticed a baggie and cigarette near the doorjamb. Based on his training, the officer believed the items were drugs and seized them. At a subsequent trial on possession charges, Cora moved to suppress the evidence based on the officer’s warrantless entry into the vehicle. The trial court granted Cora’s motion, and the state (plaintiff) appealed.
