Facts
Kyle Damato-Kushel (defendant) was charged with multiple offenses stemming from her sexual misconduct with a 14-year-old victim. The victim had an attorney appointed and requested to be present at pretrial disposition conferences held in chambers. Damato-Kushel objected to the victim’s presence at the conferences, and the court determined that because only Damato-Kushel’s attorney and not Damato-Kushel had the right to attend, the victim did not have a constitutional right to attend the conferences under Amendment XXIX of the Connecticut Constitution. The victim appealed the trial court’s ruling.
