Facts

After a softball game, John Doub, III (defendant), went to a club with his teammates and drank six beers. Doub left the club in his pickup truck and struck two parked cars as he exited the parking lot. Doub did not stop to ascertain the damage because he knew he was intoxicated and would get into trouble. Doub then consumed more alcohol and smoked crack cocaine. Shortly thereafter, Doub was speeding in his truck when he drove into the back of another vehicle, killing a nine-year-old girl. Doub did not stop and offered no aid to the vehicle’s passengers. Eventually, Doub’s girlfriend turned him into the police. The State of Kansas (plaintiff) charged Doub with second-degree depraved heart murder. A jury convicted Doub, and he appealed, arguing there was insufficient evidence to support a conviction.
