Facts
An undercover detective, posing on the Internet as a 12-year-old girl named Niki, began communicating with Louis Duke (defendant). Duke made arrangements to go to Niki’s house in order to engage in sexual acts. The two were to meet at a parking lot, where Duke was to flash his car lights so that Niki could recognize him. Duke arrived at the parking lot at the scheduled time and flashed his car lights. Duke was thereafter arrested and charged with three counts of attempted sexual battery on a child. A trial was held, but the court ultimately ordered a new trial. The prosecution appealed.
