Facts
English (defendant) was charged with murder. At trial he sought to introduce into evidence the statement of David Locke in which Locke admitted that he committed the murder. Locke did not testify at trial and his whereabouts were unknown. The trial court excluded the evidence of Locke’s confession. English appealed.
